H1015 — Flood Disclosures

H1015 was filed on February 25, 2025, and requires landlords of residential real property, developers of residential condominium and cooperative units, and mobile home park owners to provide flood-related information to prospective tenants, lessees, or purchasers before execution of a rental agreement or sales contract.

The bill mandates disclosure of specified flood information to prospective tenants, lessees, and purchasers of residential real property, condominium units, and cooperative units at or before rental agreement or sales contract execution. The bill defines "flooding" and "substantial loss or damage," authorizes tenants or lessees to terminate certain rental agreements under specified circumstances, and requires landlords and mobile home park owners to refund all amounts paid in advance for periods after the termination effective date. The bill revises flood information that must be disclosed to prospective purchasers of residential real property.
