61B-23.003 — Transition from Developer Control
Florida Administrative Code Rule 61B-23.003 establishes requirements for the transition of community associations from developer control to owner control.
The rule prescribes procedures and timelines governing when and how developer-controlled associations must transfer governance authority to owners. The rule addresses the conditions under which transition occurs, the duties of developers during transition, and the rights of owners to assume control of the association.
Community associations, including condominiums, homeowners associations, and cooperative communities, that are initially organized or operated under developer control.
Effective January 19, 1997.
