61B-80.109 — Withdrawal or Dismissal of Petition; Settlement

Rule 61B-80.109 establishes procedures for withdrawal, dismissal, and settlement of petitions in homeowners' association recall and election disputes.

The rule governs how parties may withdraw or dismiss petitions filed under the arbitration procedures for HOA recall and election disputes, and sets forth the process for settling such disputes. The rule establishes the conditions and mechanisms by which petitions may be withdrawn or dismissed and disputes may be resolved by settlement agreement.

Homeowners' associations subject to arbitration procedures for recall and election disputes under Chapter 61B-80, Florida Administrative Code.
