CTMH Services — How to file an arbitration petition

DBPR Division of Florida Condominiums, Timeshares, and Mobile Homes published procedural guidance on filing arbitration petitions.

The guidance specifies filing fees and pre-arbitration notice requirements. For condominium and cooperative disputes, a $50.00 filing fee must accompany the petition, and pre-arbitration notice to the respondent must comply with Section 718.1255(4)(b), Florida Statutes. For homeowners' association recall and election disputes, a $200 filing fee must accompany the petition, plus an additional Department fee invoiced upon conclusion of the proceeding. The guidance notes that a losing party may be required to pay the opposing party's attorneys' fees and costs.
