H1099 — Food Delivery Platforms

Bill H1099, filed January 2, 2024, proposed to regulate food delivery platforms by requiring disclosure and notice to consumers, and authorizing the Division of Hotels & Restaurants to enforce compliance.

The bill would have required food delivery platforms to disclose specified information and provide notice to consumers. It would have authorized the Division of Hotels & Restaurants of the Department of Business and Professional Regulation to issue cease-and-desist notices for violations, with opportunity to cure within a specified timeframe before enforcement or civil penalty. The bill would have preempted local regulation of food service platforms to the state level.
