S0756 — Timeshare Properties

Senate Bill 756 was filed to revise timeshare property law, including provisions on commissioners of deeds and powers of timeshare condominium boards and managing entities.

The bill proposed that a commissioner of deeds be appointed by the Secretary of State rather than the Governor for acknowledgements or proofs taken outside Florida but within the United States or a foreign country. The bill provided that the board of a timeshare condominium may exercise certain powers regarding accommodations or facilities of a timeshare plan without approval of the owners' association members under specified circumstances. The bill also proposed that the managing entity of a timeshare project has all rights and remedies of an operator of a public lodging establishment or public food service establishment for certain purposes.
