S1406 — Nicotine Products
Senate Bill 1406, the "Florida Age Gate Act," was filed to regulate the sale of single-use nicotine dispensing devices and retail tobacco product dealer permits but died in committee on June 16, 2025.
The bill would have required applicants for retail tobacco products dealer permits to consent to warrantless inspection and search, authorized the Division of Alcoholic Beverages and Tobacco to assess fines and penalties for the sale of single-use nicotine dispensing devices lacking FDA marketing authorization, and restricted advertising, promotion, and display of certain such devices by retail nicotine products dealers.
